When is the energy certificate necessary?

Royal Decree-Law 235/2013 dictates that it is mandatory to process the energy certificate for the sale or rental of a property or parts of a property regardless if they are a studio, an apartment or a commercial premise.


Exceptions


  • Properties with an area of less than 50 m2 that are completely isolated.
  • When buying a property that will be demolished or which will have to endure a major reform.
  • In the event that the property is rented for a period of less than 4 months per year.
  • Industrial buildings that are used for the delivery of workshops or a specific production activity.


How can you obtain it?

Where should it be displayed?


  • The energy certificate must be present in any advertisement to demonstrate its processing.
  • It must be included in the purchase contract.
  • All tenants who spend more than 4 months in a property must be provided with a copy when signing their rental contract.


When does it expire?


The energy certificate is valid 10 years from the moment it is obtained.

Its reading is similar to that of an energy certificate of any home appliance.


A = maximum efficiency

G = maximum deficiency


It should also be noted that energy efficiency allows estimating the energy costs of a property, therefore, it provides important information about a fixed cost that the new owner or lessee must bear.


Penalties


Law 8/2013 of rehabilitation, regeneration and urban renewal already presents cases with sanctions between € 300 and € 6,000.
